1. Introduction and acceptance

1.1  These Terms and Conditions (the “Terms”) govern your access to and use of the LEARN Data Hub website, its datasets, application programming interface (API) and related services (together, the “Platform”), operated by ENVIROMETRICS (“we”, “us”, “our”).

1.2  By accessing, browsing, registering an account, or otherwise using the Platform, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, you must not use the Platform.

1.3  The LEARN Data Hub is developed within the LEARN Project, which is funded by the European Union under the Horizon Europe programme. Views and opinions expressed on the Platform are those of the author(s) only and do not necessarily reflect those of the European Union or the European Health and Digital Executive Agency (HaDEA). Neither the European Union nor the granting authority can be held responsible for them.

1.4  We may make certain services (for example, dataset submission) available only to registered or authorised users, and additional terms may apply to those services.

2. Definitions

“Content” means all data, datasets, metadata, text, documentation, images and other material made available on the Platform.

“Dataset” means a collection of data (such as air-quality, environmental, weather or policy data) published on the Platform together with its metadata.

“API” means the application programming interface through which the Platform's Content may be accessed programmatically.

“User” / “you” means any person or entity that accesses or uses the Platform, whether or not registered.

“Account” means a registered user account on the Platform.

3. Purpose of the Platform

3.1  The LEARN Data Hub is a digital platform designed to centralise, manage and make available air-quality and environmental data, including weather data, indoor and outdoor air-quality data, and related policy strategies, in support of scientific research, public-health policy, education and innovation.

3.2  The Platform is intended to make data Findable, Accessible, Interoperable and Reusable (FAIR). It is provided for research, educational, policy and general informational purposes.

3.3  We may add, modify, suspend or remove datasets, features or services at any time without notice.

4. Registration and accounts

4.1  Certain features require you to register for an Account. You agree to provide accurate, current and complete information during registration and to keep it up to date.

4.2  You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account. You must notify us promptly of any unauthorised use.

4.3  We may suspend or terminate an Account that is inactive, that was created with false information, or that is used in breach of these Terms.

5. Acceptable use

5.1  You agree to use the Platform lawfully and responsibly. You must not:

  • use the Platform in any way that breaches applicable laws or regulations;
  • attempt to gain unauthorised access to the Platform, its servers, or any connected systems, or interfere with its normal operation;
  • introduce malware, conduct denial-of-service activity, or place an unreasonable load on the infrastructure (including through excessive or abusive API requests);
  • scrape, harvest or extract data in a manner that circumvents technical limits, disrupts the service, or breaches a dataset's licence;
  • misrepresent your identity or affiliation, or upload content you are not entitled to share;
  • use the Platform to store, publish or transmit unlawful, infringing, defamatory or personal data without a lawful basis.

5.2  We may apply reasonable rate limits and other technical controls to protect the Platform.

6. Datasets, licensing and reuse

6.1  Each Dataset on the Platform is made available under the licence stated on that Dataset's page (for example, a Creative Commons licence such as CC0 1.0 / Public Domain Dedication). The licence that applies to a Dataset governs how you may use, copy, adapt and redistribute it.

6.2  Where no licence is expressly stated, you must not assume the Content is free of restrictions; contact us before reusing it.

6.3  When reusing a Dataset, you agree to comply with the applicable licence and, where required, to provide appropriate attribution to the LEARN Project and the data source. A suggested attribution is: “Data sourced from the LEARN Data Hub (LEARN Project, funded by the European Union under Horizon Europe).”

6.4  Metadata describing the Datasets may be made available under an open licence to support discoverability and interoperability.

7. Data accuracy and “as is” basis

7.1  The Content is provided for research and informational purposes and on an “as is” and “as available” basis. While we take reasonable care, we do not warrant that the Content is accurate, complete, current, or fit for any particular purpose.

7.2  Air-quality, environmental and related measurements may contain errors, gaps or uncertainties inherent to scientific data collection. You are responsible for independently verifying the Content before relying on it, particularly for health-related, regulatory or safety-critical decisions. The Content does not constitute medical, legal or professional advice.

8. API use

8.1  The Platform provides an API to access Content programmatically. Your use of the API is subject to these Terms and to any technical documentation and limits we publish.

8.2  We may throttle, suspend or withdraw API access, or change the API, at any time. You must not use the API in a way that degrades the service for others or that circumvents applicable Dataset licences.

9. User-submitted content

9.1  If the Platform allows you to submit datasets, metadata or other material, you retain any rights you already hold in that material. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and make it available through the Platform for the purposes described in these Terms.

9.2  You represent and warrant that you have the rights necessary to submit the material and to grant this licence, and that the material does not infringe third-party rights or contain personal data processed without a lawful basis.

9.3  We may review, moderate, refuse or remove submitted material at our discretion, for example where it breaches these Terms or an applicable licence.

10. Intellectual property

10.1  The Platform, including its design, branding, logos, software configuration, and documentation (excluding individual Datasets and their separate licences, and the underlying open-source software), is protected by intellectual-property rights owned by or licensed to us and the LEARN Project consortium.

10.2  The LEARN Data Hub is built on open-source software (CKAN), which is made available under its own open-source licence. Nothing in these Terms restricts your rights under that licence.

10.3  The “LEARN” name and logos, and partner logos, may not be used without prior written permission, except as permitted for attribution under an applicable Dataset licence.

11. Third-party links and services

11.1  The Platform may link to third-party websites, data sources or services (including partner and social-media pages). We are not responsible for the content, availability or practices of those third parties, and links do not imply endorsement.

12. Availability

12.1  We aim to keep the Platform available but do not guarantee uninterrupted or error-free operation. We may suspend access for maintenance, upgrades, security or operational reasons, and the Platform may be discontinued at or after the end of the LEARN Project's funding period.

13. Disclaimers and limitation of liability

13.1  To the fullest extent permitted by applicable law, we exclude all implied warranties, conditions and terms relating to the Platform and the Content.

13.2  To the fullest extent permitted by law, we, the LEARN Project consortium, and their members shall not be liable for any indirect, incidental, special or consequential loss, or for any loss of data, profits, or opportunity, arising from your use of, or inability to use, the Platform or the Content.

13.3  Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.

14. Suspension and termination

14.1  We may suspend or terminate your access to the Platform (in whole or in part) if you breach these Terms or if we reasonably consider it necessary to protect the Platform, other users, or the data. Provisions that by their nature should survive termination (including sections 6, 7, 10, 13 and 16) will survive.

15. Changes to these Terms

15.1  We may update these Terms from time to time. The current version will always be posted on the Platform with its effective date. Material changes will be indicated by updating the “Last updated” date and, where appropriate, by notice on the Platform. Your continued use after changes take effect constitutes acceptance.

16. Governing law and jurisdiction

16.1  These Terms and any dispute arising from them are governed by the laws of European Union, without prejudice to any mandatory consumer-protection rules of your country of residence.

17. Data protection and privacy

17.1  Our processing of personal data is described in our Privacy & Data Protection (GDPR) Notice. By using the Platform you acknowledge that Notice.
